If you are married to a military man for 13 years and supported him and he cheated on you...Can you get spousal support and benefits? If you are now seperated, is he still legally cheating/adultry if he is with another woman? Can he get in trouble with the military?

Whether someone is awarded alimony is up to a judge to decide. In some states, the person's conduct is considered while in others it doesn't carry any weight. I would suggest that you consult with an attorney to get answers to your questions before agreeing to mediation.

I suspected my wife of an affair last October and can now prove it with e-mails although she will deny it. She wants mediation and I'm sure some sort of maintenance since she does not know that I know and swears on her children's lives that no contact occurred until after I moved out. I think mediation will weaken my position since I would have to reveal what I know at that time and might break confidence with her new boyfriend's wife, who provided me with the information. I feel she should get no maintenance--2 1/2 year marriage, no children.

Before you make any decisions about whether to end your marriage, you need to get information. Please consult with a lawyer to find out whether you would be able to get alimony as well as child support for your children. You will also need to investigate employment and housing options in your area so that you can make the right decisions for yourself and your family.

Depending on where you live, you may be able to use it to prove adultery. It may be a better choice to file for divorce on the grounds of marital breakdown and then you don't need to prove anything.

i am married with two children, and ive had a job here and there but never really over a month maybe three in the past five years.. but my husband and i seperated not legally for about six months and he was seeing another person. since we have been back together i found receipts that he took her and her kid out to dinner and then another reciept from a convenience store where he bought condoms. i want out of this marriage, but i dont think i can care for my children and provide them with all that they have now. i never finished school, i just passed my ged and took a couple classes at the local technical school but no degree. what can i do?

Pepper,

Deciding to end a marriage is always a difficult situation. Your son-in-law has a legal obligation to support his children. If your daughter is unable to support herself, she may be awarded spousal support until she is able to get a job. I would suggest that she do some research to find out how to apply for state aid and that she consult with a lawyer prior to telling her husband she wants out of the marriage.

My daughter is married to a immigrant from Africa, they have been married for about 2 1/2 years with 3 childern and another set of twins on the way. He as been caught cheating several times and again recently. My daughter wants out of the marriage. I would like to know how hard this is going to be for her and if there is a possiblity that she can recieve state aid for he will not help here in anyway with the exspenses of the childern.
