After you have been served with the papers, you have a certain number of days to respond. Find a lawyer to act on your behalf and take the papers to him or her so that you can get the proper advice.

I have been married to an inmate for 7 years and I have not seen him in over a year, how difficult would it be to divorce him?

You won't be awarded alimony to punish your wife for wrongdoing. If you are unable to support yourself and you have been married for a considerable period of time, you may be awarded alimony until you are able to become employable. I would suggest that you consult a family law attorney to see if the best choice for your situation is to seek an annulment or a divorce.

I have been married for 10 months, we havent consumated our marriage not even on our honeymoon in the VI. Can I anull the marriage and can I hold her responsible for 50% of the honeymoon costs. Can a man get alimony for being tricked for so long?

Unless your boyfriend has a divorce decreee, he is still married. If he wants to get a divorce, he needs to contact a lawyer to discuss serving divorce papers by publication. This means that a judge will order that a notice be put in the newspaper advising your boyfriend's wife of the proceeding. If she doesn't respond, she will be noted in default and the divorce will be granted in due course.

hi, my boyfriend and me, want to get married, but he got married 4 year ago with a argentian friend to make her legal here but they don't see each other 3 years ago, and also 3 years ago she went back home in argentina and never got her citizenship here. so is my boyfriend still married? if he is married, how he can get divorce if she is gone and he doesn't know anything about her.?

You may be able to get the Court to change the divorce settlement so that your ex husband contributes to the cost of the debt. Please consult with a lawyer to find out whether this option is available to you in your state.

My ex-husband and I finalized a non contested divorce 4 years ago and now i am having an issue that i had not considered at the time. we have a federal consolidated student loan and the majority of the balance owed is from his educational expenses and some are mine. my name is primary on the loan i am the one making all the payments. is there any way to get an adjustment in the courts to set an amount for him to have to pay each month towards this?

You may be entitled to maintenance and/or child support payments, depending on your situation. Marital assets will be divided according to the laws of the state where the divorce action is/was started. Retired pay is considered to be a marital asset; the Court will decide how it will be divided. Please contact an attorney to get advice for your situation.

I don't know that there is such a thing as a painless divorce. If you are on active duty, your divorce hearing will have to wait until active duty ends. You could contact your local Legal Aid Office to see if you qualify for assistance. If your city has a law school, see if students provide legal services to the community. Another option is to contact a firm with a number of lawyers and ask to meet with a junior lawyer; he or she will likely charge a lower hourly rate.
