Parental kidnapping is a criminal matter and it would be up to the police to investigate and determine whether charges could be laid. You would need to look at the terms of the custody order to see whether you can move with your children beyond a certain area. If you do so without an amendment, you may be in contempt of court. Please consult with your attorney to determine the best course of action for your situation.

I told my ex husband of my plans to move with her to moline, il I currently live in Lemont, IL. come summer time. my fiance are not yet married. He told me that If I take her prior to this going to court he'll have me arrested for kidnapping. Can he legally do that, with me only moving 2 hours away.

If you and your husband are able to agree about custody, child support, and how to divide your marital property, the divorce itself will be a much simpler (and less expensive) matter. You may even be able to file for divorce without a lawyer. If you do need legal counsel, a community legal clinic may be able to help.
