I live in a different state from where the marriage happened years ago, and I have long since lost any proof of the marriage. Now trying to get a divorce, how can I gather the proof that I'm married?

Uncontested means that the other person chooses not to defend the divorce. You can file for divorce and ask the Court to allow your husband to be served by publication, but you still need to demonstrate that you have attempted to locate him first.

I have been married to a man that I have not seen or heard of since 2001 and we have two children together. Does that fall under the uncontested divorce category?

Shouldn't there be a law that if you haven't seen or spoken to your spouse in years (and can prove it), that you can be considered divorced. Just like a reverse of Common Law Marriages!

The wording that you need to use for service by publication will be contained in the Court order you will need to obtain to serve the Respondent in this way. The number of days you will need to run the ad will also be determined by the judge.
