You would file for divorce in the jurisdiction where you live and follow those rules.

Your husband can file for divorce in the state where he currently resides. If you are able to agree on the terms of the divorce settlement, you will not have to appear in court. A lawyer can advise you about how to structure your settlement agreement.

We were together in California for about 5 months since we got married and after that I stayed out of the country and he stayed. My petition for change of status has already been approved but distance made it hard for us. My husband would like to file for divorce now. How should we go about this? What he wants to do is to create a marital settlement agreement, should we also include my properties outside the US?

Once your friend files the Petition, the Court Clerk's office should be able to arrange to have her husband served with the divorce papers in prison. Assuming he doesn't file an answer, he will be noted in default and the divorce will be granted in due course.

If your loved one wants to get a divorce, she doesn't need her husband's consent to get one. She needs to see a family law attorney who can help her get the necessary papers filed.
