Depending on where you live, you may be able to file a legal separation based on the fact that you are no longer living as husband and wife. I would suggest that you consult with a lawyer who can advise you about your personal situation.

For the past 4-5 years my husband and I have been living together but I am not sure where things are going from here. At that time everything was split up financially, his/mine. He makes a very good living, I work two jobs just to make ends meet. I have to pay alot of bills with my paycheck and I get no child support from him even though I have to pay for everything for our child (14 y.o) out of my pay. Any suggestions.

An annulment will only be granted in certain cir...stances. I would suggest that you make an appointment to consult with an attorney to discuss your options.

You can file for divorce if you would rather legally end the marriage than negotiate a legal separation. The issues to be decided would be the same. Please consult with an attorney to get advice for your situation.

You would need to consult with a lawyer to negotiate the terms of a legal separation. If you have entered into any agreements with your spouse, the lawyer needs to be aware of this information as well.

Connecticut is an equitable distribution state and the laws governing division of marital property can be complicated. If you want to make sure that any inheritance you receive is kept separate, ask your attorney whether you can include this provision in your separation agreement.

You would need to consult an attorney if you wanted to make changes to the legal separation, since it is a court order. It does not become invalid after a certain amount of time.

Please consult with a lawyer to see whether you can work out an informal separation agreement that does not have to be approved by a judge.

If there is a child involved, you would be better off consulting with an attorney than trying to negotiate the terms yourself.

Legal separation is not recognized in New Jersey. A divorce is not finalized until a final decree is made by a judge. This link will give you more information:

By leaving the house,(we live in New Jersey) am I putting myself at potential future risk, if things proceed to divorce, of being considered as "abandoning" my home and family? Does this put my ownership of my home, which is titled in both our names, in jeopardy?

The wife could ask the court for an order for exclusive possession, which means she is the only person who can live at the home. She also has the option of asking her lawyer whether it would be a good idea to simply change the locks to keep unwanted visitors (including the husband) out of the house if she is going to be out of town.

The male doesn't have that right during the marriage, and the fact that the couple is separated wouldn't change this fact.
