we moved to OH Aug 2007. My husband says he can't find job financially comparable to NY. I say find anything to stay in OH until you find somethig you like. He blows up and leaves. Since Jan 08, he has been living in NY. He pays the rent and utilities in OH. Visits when kids have school vacations and during holidays. I found credit card statement with motel charges in NY. Not the first time he's cheated: 3 months after we were married found him in bed with someone.... What do I need to do to file for divorce. I am completely broke, two kids and tired....

I understand that this whole situation has been very stressful for you. When you have your hearing before the judge, you will have the opportunity to tell him or her about everything that has happened. This judge may make a different ruling, since your husband had not contributed to the expenses of running the house since the petition was withdrawn. You also have the option of trying to negotiate a settlement before the hearing, but that would depend on whether your husband is prepared to do so.

My husband filed for divorce in 9/07, in 9/08 he withdrew the petition because he did not like what the judge recommended. I would get $1k per month and 55 percent of our home. Our only asset. We would split the debts. I immediately filed for divorce against him. After all he has put me through I could not believe it! Right after that he stopped giving me a pitiful $75.00 per week. Then he stopped paying all of the utilities, credit cards, my car insurance, my life insurance, his life insurance. I pay the 1st and 2nd mortgage, my own expenses, my own credit cards. Now he is saying that he is laid off. He is a plumber and makes twice as much as I do. He wants me to pay him maintenance! I will not talk to him or let him come to our home at all for over a year. We had been married for 38 years. He left me for an old girlfriend who is suppose to be a millionaire and has been divorced twice. I am cash strapped and we are not going to court until January 6th! I think he has money hidden, but the discovery has found nothing. My lawyer talks a good game, and I already owe her $6k. I am going broke trying to keep myself safe and financially secure. He has alienated every friend and family member. My poor children are completely disgusted with him. I just want this to end. Since he has stopped paying anything toward our marital home, that I have always paid out of my check for the last 20 years, do I still have to give him part of the home. I cannot refinance as I do not make enough to buy him out. With the housing market so bad, I know our house will not be worth what it was a year ago. $320k. I just don't know what to do anymore.

I am on SSI they have made life horrenous as I did not file for seperation but I have been seperated from my husband for over two years. He works out of town and stays out of town. This past mr/Apr he was on jobs locally and helped me thru operation. I am tired of the hoops of SSI and thought that actual papers would help me
